Premises Liability ("slip and fall accidents")

Premises liability is a legal term for any injury that occurs when someone slips, trips, or falls because of a dangerous condition on someone else’s property. Dangerous conditions can include ice, water, black ice, snow, uneven flooring surfaces, poor lighting, electrical cords, water hoses, or a hidden hazard such as a gap or hard to see hole in the floor.
Property owners are liable for injuries caused by a dangerous condition on their property that the owner knew or should have known about. These conditions may be obvious, such as ice or snow on a sidewalk, or hidden, such as a hole on the floor that is covered by hardboard. In general, an owner will be considered to know of a dangerous condition if the condition is permanent. If the condition is temporary, such as a water spill, the owner's liability depends on how long the condition existed before the slip and fall occurred. If the spill occurred right before the fall, a property owner may not be liable, since he/she could not have known about the spill before the slip and fall occurred. But, if the spill was present for some time before the slip and fall, or occurs in an area subject to frequent spills, the owner may be liable, even if they were unaware the spill had occurred. |
