Product liability law holds manufacturers, distributors,  retailers, repairers, assemblers, component suppliers, and testing labs of any product responsible for any injuries or damages caused by that product.  Products liability claims can be based on negligence, failure to warn, strict liability, and breach of warranty.  The key to success is to prove that the product is defective and that defect has caused your injury.  

Three types of product defects:

  • Design Defects: a flaw in the design of the product that renders the product dangerous.  This usually means that every product manufactured by that manufacturer is flawed.
  • Manufacturing Defects: a flaw in the manufacturing process that makes the product deviate from the design specifications.  This usually means that only products from certain batch are flawed.
  • Failure to Warn: a flaw in the product labels, instructions, warning, or lack thereof that renders the product unsafe because of a hidden danger.
